2. Fields of application

The present terms and conditions of sale apply to the sale of all services offered by https://artyfacts.fr/ (SIRET: 93814063900015). Artyfacts reserves the right to modify the present terms and conditions of sale at any time, provided that such modifications are posted on the https://artyfacts.fr/ website. These terms and conditions may be consulted at any time on the https://artyfacts.fr/ website.

3. Booking conditions

Reservations can be made by e-mail to contact@artyfacts.fr.

The service provider, Artyfacts, undertakes to contact the customer by email or telephone within 72 working hours to discuss the customer’s request and specific needs and expectations.

The service provider also undertakes to send a proposal for the service, one or more dates and a detailed quote within 72 working hours after this initial exchange. The quote is valid for 30 days. The service is confirmed only after receipt of the quote, dated and signed by the customer and marked “Bon pour accord” (“Good for agreement”).

Any order implies acceptance of the prices and services offered for sale. Ordering a service implies full acceptance and adherence to these general terms and conditions of sale, which are sent with the detailed quote.

4. Terms of payment

Payment must be made in one go at the latest 7 days after the end of the service. Payment may be made at the end of the tour by credit card, check drawn on a bank domiciled in mainland France and made payable to Artyfacts or in cash, or within 7 days by check or bank transfer, indicating the quote references in the reason for the transfer. On receipt of payment, Bérénice Gaupillat will send the customer confirmation and an invoice. Artyfacts cannot be held responsible for non-receipt of a check sent by regular mail.

No discount will be granted for early payment.

Any delay in payment will incur penalties calculated at the applicable legal rate, set by article L441-10 of the French Commercial Code, plus 10 percentage points. A fixed indemnity of €40 for collection costs will also be applied, in accordance with legislation.

5. Rates

The tour prices shown on the https://artyfacts.fr/ website are in euros. In accordance with article 293 B of the French General Tax Code, VAT is not applicable and is therefore not charged. These rates may vary at any time, but services will always be invoiced on the basis of the quote.

The reservation of the service(s) is considered definitive on receipt of the quotation, dated and signed by the customer and accompanied by the words “Bon pour accord” (“Good for agreement”).

6. Cancellation conditions and charges

6.1 Cancellation by Artyfacts

Artyfacts undertakes to be present on the date, at the time and in the place agreed at the time of booking. In the event of force majeure (see details below) or site closure preventing Artyfacts from providing the service, the customer may choose between three options :

  • Free cancellation of the tour
  • Postponement of the tour to a later date
  • Modification of the initial tour

6.2 Cancellation by the customer

The customer undertakes to be present at the date, time and place of the appointment agreed at the time of booking and before the tour begins. In the event of late arrival, the customer may be refused access to the site (museum, monument, castle, etc.), without this constituting grounds for non-billing or postponement of the tour.

If the customer cancels the service after the agreed appointment time, or does not show up within 30 minutes of the agreed time, the customer will not receive any exchange of visit and will be invoiced for the full amount of the order.

In the event of cancellation (except in cases of force majeure, see details below) of the service by the customer after confirmation of the booking and signature of the quotation, the billing conditions are as follows :

  • Cancellation made more than 30 days before the start of the tour : the order will not be invoiced.
  • Cancellations made between 30 and 15 days before the start of the tour : 25% of the order will be invoiced.
  • Cancellations made between 15 and 7 days before the start of the tour : 50% of the order will be invoiced.
  • Cancellations made between 7 days and 48 hours before the start of the tour : 75% of the order will be invoiced.
  • Cancellation made less than 48 hours before the start of the tour : the order will be fully invoiced.

6.3 Force majeure

Force majeure or fortuitous event means any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code, beyond the control of Artyfacts or any of its suppliers, subcontractors or carriers, and which prevents the performance of the services sold, in particular acts of public authority, hostilities, wars, riots, natural disasters, fires, floods, exceptional bad weather, hindering the smooth running of Artyfacts or that of one of its suppliers, subcontractors or carriers, as well as damage, failures or delays on the part of one or more service providers, the blocking of telecommunications, the blocking of the Internet, the breakdown of equipment broadcasting the service, the interruption of transport, the supply of energy or raw materials, etc. The party wishing to invoke an event of force majeure must immediately notify the other party of the beginning and end of this event, failing which it cannot be relieved of its responsibility.

7. Visiting conditions

7.1 Schedules and delays

The guide undertakes to be present at the date, time and meeting point agreed at the time of booking. The customer must ensure that they are present on the date, at the time and at the meeting point defined for the tour departure.

If the customer is late, the guide undertakes to wait for the customer for a maximum of 30 minutes after the agreed appointment time. Clients are strongly advised to contact Artyfacts by telephone or text to inform the guide of the delay and its duration. The guide does not guarantee that the tour can be extended if the customer is late. In the event of a long delay, a postponement of the tour may be considered.

In the event of no-show or no news from the customer within 30 minutes of the scheduled appointment time, the tour will be cancelled and the service will be fully invoiced.

Tours are maintained regardless of weather conditions, except in the event of storms that make it impossible to ensure the safety of the guide and client during the tour.

7.2 Mobility and disability

Artyfacts adapts to each customer. People with disabilities are welcome. Artyfacts is committed to doing its utmost to facilitate the visit, whatever the disability.

When booking, it is necessary to specify the practical requirements according to the disability and the adaptation of the services to be provided. Artyfacts will then make a request to the place of service for mobility problems. Should access to the site not be possible due to a lack of infrastructure, Artyfacts cannot be held responsible.

In the case of deaf or hard-of-hearing people, Artyfacts can redirect the customer to a guide who speaks sign language.

8. Contents and credits

The services marketed and featured on the https://artyfacts.fr/ website comply with current French regulations. The texts and photographs on the https://artyfacts.fr/ website are non-contractual and Artyfacts cannot be held responsible in any way whatsoever.

Any reproduction, representation or use, in whole or in part, of the elements making up this site, is forbidden without the prior agreement of the publication manager. Failure to comply with this prohibition constitutes an infringement and will immediately engage the civil and criminal liability of the infringer.

The content of the site may contain technical inaccuracies or omissions. Artyfacts declines all responsibility for the use that may be made of the information published on its site. Artyfacts shall not be held liable for any damages resulting from the use or interpretation of information contained on the site.

Artyfacts accepts no responsibility for links from other websites to its own website. This in no way implies that Artyfacts endorses these sites or their content. 9. Liability

During the tour, participants are responsible for their own personal liability. Artyfacts cannot be held responsible, particularly in the event of:

  • Theft or loss of valuables belonging to the customer or participants during the event
  • Bodily injury or material damage suffered by the customer or participants during the service
  • Damage, direct or indirect, of any nature whatsoever, that the customer or participants may cause to other participants
  • Damage caused by the customer or participants in the museums or sites visited

10. Privacy

Photos and videos may be taken during the tour, in accordance with the rules laid down by each site. Should these photos and videos be posted on the Internet, the agreement of all persons appearing in them, including the guide, must be obtained beforehand.

No full audio or video recording of the visit is permitted.

11. Disputes

Any claim relating to a service must be submitted to Artyfacts within 72 working hours of the end of the service and only by registered mail. In the event of persistent disagreement, disputes may be submitted to Bérénice Gaupillat, who will endeavour to reach an amicable agreement. Any dispute arising from the application of the present terms and conditions shall fall within the exclusive jurisdiction of the French courts.
